On February 23, 2005, a pharmacist at a Chicago Osco refused to fill a medical prescription for contraceptives for two of Planned Parenthood/Chicago Area's (PP/CA) female patients. After bringing the issue of pharmacists' refusal to fill prescriptions for contraceptives to the forefront of national debate, Planned Parenthood stood with Illinois Governor Rod Blagojevich as he proposed an Emergency Rule, effective immediately, to require pharmacies to fill prescriptions without delay. On April 1, 2005, Illinois Governor Rod Blagojevich promulgated an emergency rule that that requires pharmacies that sell contraceptives to fill prescriptions for birth control without delay. If the contraceptive, or a suitable alternative, is not in stock, the pharmacy must order or obtain the contraceptive or, if the patient prefers, transfer the prescription to another local pharmacy of the patient’s choice or return it to the patient for filling elsewhere. The emergency rule was challenged in a lawsuit filed April 13, 2005.
